How the DNC Is Suing The Trump Administration

One of the main questions we get from supporters is how the DNC is taking real action to hold Trump accountable.
One of the best answers to this is the DNC’s Legal Team. Our Legal Team is the backbone of this fight, taking Trump and his administration to court to ensure our elections remain free and fair.
From challenging threats to mail-in voting to countering RNC litigation, our Legal Team is fighting each and every day to hold Trump accountable for his threats to interfere with our elections. In this year’s midterms and beyond, we are working around the clock to defend Americans’ right to vote in the courts.
This week, we’re pulling back the curtain on how we’re suing the Trump administration to demand accountability and uphold our election systems. We are securing real victories for democracy and powering the fight to win big in 2026, 2028, and beyond. Keep reading to learn more about the DNC Legal Team, how we’re fighting in court, and what’s at stake this year.
DNC In-House Litigation
The DNC has our very own in-house Litigation Director, Dan Freeman, who is hard at work to ensure elections remain free and fair. With nearly 15 years of experience at the Department of Justice, Dan is a decorated voting rights litigator who forced states to register more than one million voters through litigation and settlements.
At the DNC, Dan and the Legal Team are fighting back to hold Trump’s DOJ accountable to the American people. The Legal Team works with major law firms to bring lawsuits that protect voters nationwide. Recently, the DNC sued the Trump administration for the first executive order on election administration, where they successfully blocked multiple provisions of the order.
The Legal Team also litigates to fight back against the DOJ and the Republican National Committee. The DOJ is trying to seize state voter files and federalize elections, but the DNC has filed briefs defending more than 20 states against DOJ lawsuits. So far, six federal courts have rejected DOJ’s demands, and we expect wins will keep coming.
An Update on Our Active Lawsuits
Last month, the DNC, alongside Senate Democratic Leader Chuck Schumer, House Democratic Leader Hakeem Jeffries, the Democratic Senatorial Campaign Committee, the Democratic Congressional Campaign Committee, and the Democratic Governors Association, filed a lawsuit challenging Donald Trump’s illegal executive order that attacks Americans’ right to vote by mail.
The suit aimed to strike down the Trump administration’s power grab that would limit Americans’ ability to mail in their ballots. This unconstitutional effort by Trump is yet another attempt to take over elections and help Republicans cling to power. The DNC Legal Team is taking action in court to make sure every American has their voice heard in the midterms.
In March, the DNC sued the Trump administration over its failure to respond to Freedom of Information Act (FOIA) requests on any plans to deploy federal agents or troops to polling places, drop boxes, and election offices in upcoming elections.
While Donald Trump threatens to intimidate voters at the ballot box, the DNC is taking real action in court. We’re demanding transparency and accountability for his attempts to cheat his way through a midterm election that he knows Republicans will lose. The court must now enforce FOIA requirements to ensure that the American people obtain timely knowledge of potential threats to free and fair elections. DOJ has moved to strike parts of the suit as “false,” “sensationalized,” and “impertinent.” We’ll get back to them soon.
What’s Next for the Legal Team
Last week, the Supreme Court gutted the core requirement of the Voting Rights Act to protect minority opportunity districts. In Louisiana v. Callais, the Court overturned decades of precedent and opened the door to diluting Black, Latino, AANHPI, and Native American representation across the country.
The goal is clear: Trump and Republicans want to rig congressional maps in their favor ahead of the 2026 midterms. It is a dark time for voting rights in America, but our Legal Team will fight every step of the way to ensure the voices of all Americans will be heard. In the months leading up to the midterms, our Legal Team will be taking action to take a stand against the Trump administration and their MAGA allies in statehouses across the South and around the country.
